Evidence is the backbone of every disciplinary hearing — yet misunderstanding the rules around it is one of the most common reasons outcomes are overturned. This workshop gives delegates a thorough grounding in the types of evidence they will encounter, from documentary and circumstantial evidence to polygraphs, video recordings and hearsay. Delegates will learn how to evaluate conflicting versions, assess witness credibility and correctly apply the balance of probabilities standard. Practical exercises ensure delegates can avoid common pitfalls and confidently make findings.

Here’s what we will be covering:
- Types of Evidence – understanding direct, circumstantial, real, documentary and hearsay evidence in disciplinary proceedings. Including use of polygraphs and reliance on video recordings and witness statements.
- Conflicting Versions – evaluating and determining credibility and reliability when there are conflicting versions. What are the guidelines?
- Onus of Proof – understanding the difference between the balance of probabilities and beyond reasonable doubt and what this means for disciplinary outcomes; how to evaluate evidence on a balance of probabilities, when the burden may shift to the employee and how to weigh probabilities when evidence is seemingly evenly balanced.
- Practical Application – avoiding common pitfalls and applying the correct tests when making findings.
